AckerWorx UK · Legal
Effective date: 5 November 2026
These Terms of Service ("Terms") govern your use of the AckerWorx UK website (ackerworx.uk) and all Android applications published by AckerWorx on Google Play (together, the "Services"). The Services are provided by AckerWorx Ltd ("AckerWorx", "we", "us", "our"), a company registered in England and Wales under Company Number 15193933.
By downloading, installing, or using any of the Services you agree to these Terms. If you do not agree, do not use the Services. If you are using the Services on behalf of a business, you confirm that you have authority to bind that business, and "you" refers to that business.
Other AckerWorx products and platforms, including XenoPOS (xenopos.com), AckerWorx.Net, AckerWorx.Com, and AckerWorx.Dev, have their own terms published on their respective websites. These Terms do not apply to them.
AckerWorx Ltd acts as a trader in relation to the Services. If you are a consumer in the United Kingdom or the European Economic Area, nothing in these Terms affects your statutory rights, including rights under the Consumer Rights Act 2015 relating to digital content that is not as described, not fit for purpose, or not of satisfactory quality.
Our trader contact details are given in the "Contact" section at the end of these Terms.
Subject to these Terms, AckerWorx grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Services on Android devices you own or control, for your personal or internal business use.
You must not:
Our Android apps are distributed through Google Play and are also subject to the Google Play Terms of Service. Where these Terms conflict with Google Play's terms in relation to distribution, billing, or refunds through Google Play, Google Play's terms govern that matter.
Each app has its own privacy policy at ackerworx.uk/android/<app-name>. Some apps include free features supported by a single banner advertisement and a one-time Premium purchase that removes advertising or unlocks additional features. Premium is a one-time purchase, not a subscription, unless the Google Play listing clearly states otherwise.
Some apps, such as NodeSpectra, provide network analysis and diagnostic tools. You may only use these tools on networks and devices you own or have explicit permission to test. You are solely responsible for ensuring your use complies with applicable law, including the Computer Misuse Act 1990.
In-app purchases in our Android apps are made through Google Play Billing and are subject to Google Play's refund policy. Prices are shown in the Google Play listing before you buy. In addition, if you are a UK or EEA consumer and the purchased digital content is faulty, you may be entitled to a repair, replacement, or refund under consumer law. Contact us and we will help.
Always purchase from Google Play or an official AckerWorx domain. We are not responsible for counterfeit products or keys purchased elsewhere.
The Services, including all software, designs, text, graphics, logos, and trademarks, are owned by AckerWorx Ltd or its licensors and are protected by copyright, trademark, and other laws. Except for the licence expressly granted in these Terms, no rights are granted to you.
Data you create or enter using the Services (such as recordings, scan results, or sales records) remains yours. You grant AckerWorx a licence to process that data only as needed to provide the Services to you.
The Services may connect to third-party services (for example radio stream servers, cover-art and lyrics lookups, IP reputation providers, payment processors, or Google AdMob). Those services are operated by third parties under their own terms and privacy policies. AckerWorx does not control and is not responsible for third-party content, availability, or conduct. Radio station content in our streaming apps is controlled by the broadcasters.
AckerWorx does not implement backdoors in its software and does not retain encryption keys for government or third-party access. If a change in law would require us to do so for a product sold through AckerWorx UK, we will withdraw that product from sale in the UK rather than comply, as we have done previously with our encryption software. We will tell you if this affects a product you have purchased.
We may update, change, or discontinue any part of the Services at any time. We will give reasonable notice before discontinuing a product you have paid for, where it is practical to do so. Our Android apps run on your device and will generally continue to work after an update stops, but third-party services they rely on may change without our control.
Except as expressly stated in these Terms, and to the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
Network diagnostic results, speed tests, security scores, and reputation lookups are indicative only and should not be relied upon as the sole basis for security or business decisions.
Nothing in this section limits your statutory rights as a consumer.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
Subject to the paragraph above, AckerWorx shall not be liable for any loss of profit, loss of business, loss of revenue, loss of data, business interruption, or any indirect or consequential loss arising out of or in connection with the Services.
Subject to the paragraphs above, our total liability to you arising out of or in connection with the Services in any 12-month period shall not exceed the greater of (a) the amount you paid to AckerWorx for the Services in that period, and (b) £100.
You are responsible for backing up data you create with the Services. We are not liable for loss of data where a backup would have prevented that loss.
If you are using the Services for business purposes, you agree to indemnify AckerWorx against claims, losses, and costs arising from your breach of these Terms, your unlawful use of the Services, or your failure to comply with laws applicable to your business (including data protection and tax law).
You may stop using the Services at any time by uninstalling them. We may suspend or terminate your licence if you materially breach these Terms and, where the breach can be remedied, fail to remedy it within 14 days of notice. On termination, the licence granted to you ends and you must stop using the Services. Sections relating to intellectual property, disclaimers, limitation of liability, indemnity, and governing law survive termination.
We may revise these Terms from time to time. The revised Terms will be posted on this page with a new effective date. Where a change is material and affects a product you have paid for, we will give you reasonable notice, and your continued use after the effective date constitutes acceptance. If you do not accept the revised Terms, you must stop using the Services.
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that if you are a consumer resident elsewhere in the United Kingdom or in the EEA, you may also bring proceedings in the courts of your home country and benefit from mandatory consumer protection provisions of that country's law.
If you are an EEA consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
